You must agree to the following terms and conditions to use this website mgswebdesign.ie and the services provided by MGS LTD - We may revise and update these terms and conditions from time to time and you are responsible for periodically reviewing the most current version on this website.

New Websites & Website Re-Designs

A deposit is required before work can begin on any new website or website re-design.

Invoices are issued after an online preview of your new website is made available to you and any outstanding balance must be paid in full within 30 days of the invoice date. During this period you can request further changes to be made. After this 30 day period, full payment must be made for us to continue work on your website.

Full payment must be made before going live on your domain.

The maximum period of time covered for any job, unless specified otherwise, is 60 days from the invoice date. Any changes requested after this period may incur additional charges.

Additional functionality that is not covered in your website package or quote may incur additional charges. In such cases we will only carry out such work after you have been notified of this and have given us the go ahead.

Provision of your website does not include unrestricted rights to all underlying software and technologies. Software, widgets and apps used in the creation and operation of your website may be provided subject to their own separate licence agreements, terms and conditions.

Going live on your domain constitutes completion of the work quoted/invoiced for and unless specified otherwise any additional changes requested after going live may incur additional charges which will be charged at our hourly rate or quoted for separately.

Design, Development & Research

Full payment is required for any work carried out on your behalf. Quotations and invoiced amounts cover the processes and time spent researching, designing and developing, not just the end result. Whilst we do our best to achieve exactly what a client is looking for, in the situation where the end result is not satisfactory, full payment is still required. Payments made for design and development work and for research carried out can not be refunded. This does not affect your statutory rights.

Domain Names

Payment must be made before a domain name can be registered, transfered or renewed. Domain names are at risk if they are not renewed before their renewal date.If a domain name drops because payment was not received on time it may or may not be possible to re-register it. Where re-registration is possible a re-registration fee will apply, the amount will depend on the type of domain and the fees charged by the registrar and/or new owner.

Website, Hosting & Email Uptime/Downtime

Websites and associated web services such as hosting and email are susceptible to technical difficulties, crashes and down time. We use our best efforts to provide and maintain a consistent and reliable online presence for our own websites and for our client websites and their associated web services, but we cannot and do not guarantee a continuous and uninterrupted service. We reserve the right to suspend, terminate or cease the web services we offer and access to this website and client websites and their associated services, temporarily or permanently at any time without prior notice.

Refunds

Non-tangible Irrevocable Goods
We do not issue refunds for non-tangible irrevocable goods such as research, design and development work, website listings, advertisements, downloads and other digital goods. As a customer you are responsible for understanding this upon purchasing any such item or service from us.

Deposits for new websites and website re-designs cover initial research, design and development work and are non-refundable.

This refund policy does not affect your statutory rights.

Privacy Policy

All personal details submitted via the website or by email associated with the website are used by us solely in the operation and management of the website and are also used to allow us to provide you with information on the services and products we provide.

To help promote and advertise your website/business we may use the information relating to your website/business on marketing and advertising material on our website and other third party websites including but not limited to social networking websites such as facebook and twitter.

Personal information will not be disclosed by us to any third party except where it is necessary for us to do so as part of providing a service or product to you – e.g. arranging delivery of a product, carrying out credit and other security checks and for the purposes of customer research and profiling or where we have your express permission to do so. We may collect information about your visit to the website either directly or by using third party website/software for analytical purposes, so as to help us improve website content, navigation and our products and services as a whole for new and returning visitors. We may use your personal information to contact you in relation to the website and related services or in relation to other services or products provided to you by us.
